IRDAI Partners With IPAI To Curb Dark Patterns In Insurance Sector To Boost Transparency And Consumer Protection

IRDAI has joined hands with the Institute of Public Auditors of India (IPAI) to identify and monitor dark patterns in the insurance sector. The initiative aims to curb insurance mis-selling, improve transparency, strengthen consumer protection, and restore public trust in digital insurance platforms.

Why IRDAI Is Taking Action

Mis-selling has remained a major concern in the insurance industry, with insurers, brokers, agents, and banks often accused of using misleading sales practices to market complex insurance products.

To address this issue, IRDAI is tightening its oversight of dark patterns—deceptive design practices that influence consumers into making decisions they might not have otherwise made.

The regulator believes that eliminating such practices will make the insurance ecosystem more transparent, trustworthy, and consumer-friendly.

What Are Dark Patterns?

Dark patterns are deceptive design techniques used on websites and mobile applications to manipulate users into taking unintended actions.

Some common examples include:

  • Asking users to provide excessive personal information before displaying insurance products.

  • Hiding policy details, exclusions, or charges behind multiple screens.

  • Making policy cancellation unnecessarily complicated.

  • Automatically selecting optional add-on products.

  • Sending frequent spam calls and promotional messages.

  • Concealing important terms and conditions.

Such practices limit informed consumer choice and contribute significantly to insurance mis-selling.

IRDAI’s New Measures

To tackle the growing issue of dark patterns, IRDAI has announced several key initiatives:

  • Partnered with the Institute of Public Auditors of India (IPAI) to independently identify and monitor dark patterns in the insurance sector.

  • The independent monitoring exercise will continue for nine months.

  • In April 2026, IRDAI directed all insurers to conduct a self-assessment of their digital platforms for the presence of dark patterns.

  • Since most insurers reported that they were not using such practices, the regulator decided to commission an independent audit.

  • The study will identify companies using manipulative digital practices and recommend corrective measures.

Concerns Raised by IRDAI Chairman

IRDAI Chairman Ajay Seth highlighted that many insurance websites require customers to share large amounts of personal information even before allowing them to view products or compare prices.

According to him, consumers should be able to:

  • Compare insurance products without unnecessary obstacles.

  • View prices before sharing excessive personal information.

  • Clearly understand policy features and benefits.

  • Make informed purchasing decisions without being influenced by manipulative digital practices.

He emphasized that consumer trust is essential for increasing insurance penetration across the country.

Upcoming Insurance Distribution Reforms

IRDAI is expected to release a consultation paper in July 2026 proposing broader reforms to insurance distribution.

The proposed reforms are likely to include:

  • Measures to reduce insurance mis-selling.

  • Greater transparency in insurance sales.

  • Changes to the commission-based distribution model.

  • Stronger consumer protection guidelines.

  • Standardized disclosure norms across digital insurance platforms.

These reforms are intended to make insurance sales more ethical, transparent, and customer-centric.

Link with RBI’s Consumer Protection Framework

IRDAI’s initiative follows the Reserve Bank of India’s (RBI) framework aimed at preventing the mis-selling of financial products by banks, which will come into effect on 1 January 2027.

As many banks also distribute insurance products, IRDAI plans to introduce similar safeguards specifically for insurance distribution to strengthen consumer protection.

How Serious Is the Problem?

According to a LocalCircles survey involving more than 87,000 respondents:

  • Around 80% reported facing hidden charges, forced sharing of personal data, or difficulties while cancelling insurance policies.

  • Nearly 90% said they received repeated unsolicited calls and promotional messages encouraging them to purchase or continue insurance policies.

The survey covered major digital insurance platforms and indicates that deceptive practices remain widespread across the insurance industry.
