The Supreme Court on Friday assured three academicians associated with the now-withdrawn NCERT Class 8 sub-chapter titled “Corruption in Indian Judiciary” that certain adverse observations made earlier against them would be removed from the record. These remarks had reportedly questioned their academic credibility and suggested that educational institutions might hesitate to engage them in the future.
As reported by ANI, the matter was heard by a Bench comprising Chief Justice of India Surya Kant and Justice Joymalya Bagchi. During the proceedings, the Court clarified that its earlier criticism in the suo motu case was aimed at the textbook content itself and not at the scholars who contributed to it.
Justice Bagchi acknowledged that the earlier comments may have had an impact on the academicians and stated that the Court had decided to withdraw the harsher portions of its observations.
Court clarifies its concerns over textbook presentation
Senior advocates Shyam Divan, Gopal Sankarnarayanan, and J. Sai Deepak, representing the academicians, requested the Bench to expunge remarks that they argued had harmed the professional standing of their clients. They submitted that the authors had no intention of undermining the judiciary.
The Supreme Court responded that it was not against academic debate or discussion concerning the judicial system. However, the Bench expressed concern over the way the textbook chapter portrayed corruption, suggesting that the issue was presented in a one-sided manner that failed to reflect the broader functioning and contribution of the judiciary.
The judges observed that the chapter lacked balance and did not adequately highlight the judiciary’s role in safeguarding justice and constitutional values.
Bench stresses responsibility in educational content
The Court also advised educators and academicians to exercise caution and responsibility while preparing educational material related to constitutional institutions and sensitive public issues.
According to the Bench, academic content should maintain fairness, restraint, and respect for the justice delivery system. Justice Bagchi noted that several important aspects connected to the judiciary had been omitted from the chapter, including legal aid programmes, access to justice initiatives, and the role judges play in strengthening legal services.
The Court observed that these significant contributions should have been reflected to provide students with a more balanced understanding of the judiciary.
Background of the controversy
The issue arose after the inclusion of the sub-chapter “Corruption in Indian Judiciary” in an NCERT Class 8 textbook drew criticism from various quarters. The Supreme Court later took suo motu cognisance of the matter and made strong observations regarding the content and its preparation.
Following the controversy, the sub-chapter was removed from the textbook. During Friday’s hearing, the Court recognised that some of its earlier remarks may have been excessive and assured the academicians that those comments would be deleted from the official record.
