The Food Safety and Standards Authority of India (FSSAI) has proposed a comprehensive ban on plastic-based packaging for pan masala, gutka, and similar products. The draft amendment to the Food Safety and Standards (Packaging) Regulations, 2018 seeks to replace single-use plastic sachets with environmentally friendly materials such as paper, paperboard, cellulose, and other naturally derived alternatives. This initiative forms part of a broader strategy to reduce plastic waste and strengthen public health regulations.
Key Provisions of the Draft Amendment
The proposed regulation mandates that pan masala, gutka, and related tobacco products be packaged exclusively in non-plastic materials. It prohibits the use of all plastic types, including polyethylene, polypropylene, polyester, PVC, and multilayer laminates.
In addition, the draft disallows the use of aluminium foil and metallised layers commonly found in sachet packaging. These restrictions apply to both tobacco and non-tobacco variants of pan masala, thereby expanding the scope of regulation.
Restricted Materials and Chemical Additives
FSSAI has also banned certain copolymers, including vinyl acetate–maleic acid–vinyl chloride, in packaging for gutka, pan masala, and tobacco-related products. These updates have been incorporated into Schedule IV of the Packaging Regulations, which outlines approved materials for various food categories.
Pan masala has been introduced as a distinct category with stricter packaging requirements, aligning the framework with the existing Plastic Waste Management Rules.
Significance of the Proposal
The pan masala and chewing tobacco industry largely relies on multilayer plastic sachets, which are difficult to recycle and contribute significantly to environmental pollution. Given the widespread consumption of these products in India, they generate substantial non-biodegradable waste.
The proposed changes aim to curb plastic pollution while also reinforcing regulations on products associated with serious health risks such as oral cancer and addiction.
State-Level Actions and Future Steps
Several states—including Maharashtra, Bihar, Tamil Nadu, Andhra Pradesh, Telangana, Odisha, West Bengal, Kerala, Gujarat, and Delhi—have already imposed bans on the manufacture, sale, storage, and distribution of gutka and tobacco-based pan masala. Most of these restrictions are periodically renewed.
FSSAI has invited stakeholders to submit objections and suggestions within 30 days of the draft notification. After reviewing the feedback, the authority will finalise the amendment. If implemented, the regulation is expected to significantly transform packaging practices in the pan masala and chewing tobacco industry while advancing both environmental protection and public health objectives.
