India’s online gaming industry is set to come under a new regulatory structure with the Online Gaming Authority of India (OGAI) scheduled to begin operations from May 1, 2026. The authority has been created under the Promotion and Regulation of Online Gaming Act, 2025, with the objective of establishing a transparent and well-organised framework for the sector in India.
This initiative comes in response to the rapid expansion of India’s digital gaming ecosystem, which includes real-money gaming, fantasy sports, esports, and various skill-based platforms. The government aims to strengthen oversight while ensuring the sector continues to grow in a responsible and regulated manner.
OGAI under MeitY supervision
The Online Gaming Authority of India will operate as a digital body under the Ministry of Electronics and Information Technology (MeitY). It will be headed by the Additional Secretary of MeitY, ensuring direct administrative control by the central government.
The authority will also include Joint Secretary-level representatives from several key ministries, including the Ministry of Home Affairs, Department of Financial Services, Ministry of Information and Broadcasting, Ministry of Youth Affairs and Sports, and the Department of Legal Affairs.
Regulatory responsibilities
OGAI will oversee the entire online gaming ecosystem in the country. Its key functions will include identifying and registering online games, including approved esports titles and skill-based platforms. It will also determine whether a game complies with legal standards, helping to reduce ambiguity that has long existed due to differing state-level rules.
Data governance and compliance role
In addition to registration, OGAI will have the authority to issue guidelines on data retention, platform accountability, and regulatory compliance. This covers monitoring user data handling, financial transactions, and ensuring responsible gaming practices. These measures are intended to strengthen consumer protection and address concerns such as fraud, addiction risks, and misuse of online platforms.
No registration for non-real money games
The government has clarified that games not involving real-money transactions will not require mandatory registration. This step is designed to ease compliance requirements for casual gaming and entertainment-based platforms while focusing regulation on real-money gaming segments.
The establishment of OGAI is expected to provide clearer policy direction, improve investor confidence, and enhance governance in India’s rapidly growing online gaming industry.
