The U.S. Department of Education has introduced a Notice of Proposed Rulemaking to create a new accountability system for colleges and universities. The proposal focuses on identifying academic programmes that do not provide graduates with sufficient financial returns. It is supported by provisions from the Working Families Tax Cuts Act and existing regulatory powers.

This initiative comes at a time when the federal student loan balance is approaching $1.7 trillion, raising concerns that many students are graduating with debt but limited earning potential. Officials say the proposed changes are intended to better connect educational outcomes with job market realities and reduce excessive borrowing.

Earnings-Based Accountability Criteria

Under the proposed rules, undergraduate programmes could lose access to federal student loans if graduates earn no more than individuals with only a high school diploma. Similarly, graduate programmes would need to show that their graduates earn more than the average bachelor’s degree holder.

Programmes that repeatedly fail to meet these standards may also risk losing access to Pell Grants. The framework would apply equally to all institutions, creating a uniform accountability system across public, private, and nonprofit colleges.

Role of the AHEAD Committee

The proposal is based on recommendations from the Accountability in Higher Education and Access Through Demand-driven Workforce Pell Committee (AHEAD Committee). This group includes representatives from various sectors such as education, business, legal aid, and student advocacy. Earlier this year, the committee reached consensus on a model that evaluates programme performance using federally collected earnings data.

The framework spans all levels of higher education—from certificate courses to advanced degrees—and builds on existing policies like Gainful Employment and Quality Assurance Authority provisions.

Public Feedback Process

The draft regulation is open for public comment for 30 days. Stakeholders can submit their responses through the Federal eRulemaking Portal until May 20, 2026. After reviewing the feedback, the Department may revise the proposal before final implementation.

This rule is the third and final component of a broader reform package aimed at improving federal student aid systems under the Higher Education Act of 1965. The process follows legally mandated negotiated rulemaking procedures that require stakeholder consultation.

Background

The Department first announced plans for negotiated rulemaking on July 25, 2025, following updates to federal student aid laws. The AHEAD Committee concluded its discussions on January 9, 2026, after multiple sessions, with all members supporting the draft framework.

While earlier administrations attempted similar reforms without consensus, this proposal represents a unified approach designed to streamline regulations and establish consistent standards across the higher education sector.
