Description

India has submitted its first National Report on the Nagoya Protocol on Access and Benefit Sharing (ABS) to the Convention on Biological Diversity (CBD). The report, submitted on 27 February 2026 by the Ministry of Environment, Forest and Climate Change (MoEFCC) in collaboration with the National Biodiversity Authority (NBA), details India’s progress in biodiversity governance, access and benefit sharing, and community participation between 1 November 2017 and 31 December 2025.

Global Significance of India’s Nagoya Protocol Report

The report has been submitted under Article 29 of the Nagoya Protocol, which mandates countries to monitor and report their progress in implementing ABS regulations. The protocol ensures that benefits derived from the use of genetic resources and traditional knowledge are shared fairly with the countries and communities that provide them.

India’s submission demonstrates the country’s commitment to the Convention on Biological Diversity and aligns with Target 13 of the updated National Biodiversity Strategy and Action Plan (NBSAP). India had previously submitted an interim report in November 2017.

Legal Framework for Access and Benefit Sharing in India

India’s ABS framework operates under the Biological Diversity Act, 2002, which provides the legal basis for managing biodiversity resources. This framework is further strengthened by the Biological Diversity Rules, 2024 and ABS Regulations, 2025, ensuring effective implementation at all administrative levels.

Three-Tier Biodiversity Governance in India

India follows a three-tier governance structure to implement the Nagoya Protocol, allowing participation at national, state, and local levels:

  • National Level: National Biodiversity Authority (NBA)

  • State Level: State Biodiversity Boards (SBBs) and Union Territory Biodiversity Councils

  • Local Level: Biodiversity Management Committees (BMCs)

To date, India has established over 2,76,653 Biodiversity Management Committees, enabling local communities to actively participate in biodiversity conservation and benefit-sharing mechanisms.

Financial Outcomes from ABS Implementation

The Nagoya Protocol ABS framework in India has generated significant financial benefits:

  • Rs 216.31 crore mobilized through NBA approvals

  • Rs 139.69 crore distributed to benefit claimers, including local communities, farmers, and traditional knowledge holders

  • Rs 51.96 crore generated through State Biodiversity Board approvals

The Nagoya Protocol, adopted in 2010 under the Convention on Biological Diversity, focuses on Access to Genetic Resources and Fair and Equitable Sharing of Benefits (ABS) arising from their use. The protocol ensures that countries and indigenous communities receive fair benefits when their biological resources or traditional knowledge are utilized in research, pharmaceuticals, agriculture, or biotechnology. It also promotes sustainable biodiversity conservation while encouraging scientific innovation.
