The Madras High Court has issued an interim stay on the construction of a major residential project located close to Chennai’s Pallikaranai Marsh, an ecologically sensitive wetland listed under the Ramsar Convention. The decision came after a public interest litigation (PIL) raised alarms over potential environmental damage, alleged legal violations, and increased flood risks to nearby areas.

Court Orders Temporary Suspension Of Project

A division bench headed by Chief Justice M.M. Srivatsava and Justice Arul Murugan passed the order while hearing a PIL filed by AIADMK legal wing member J. Brezhnev. The petitioner sought the revocation of approvals granted to the ?2,000-crore Brigade Morgan Heights project and demanded a construction ban within a one-kilometre radius of the marshland.

The court has directed the Tamil Nadu government and the Chennai Metropolitan Development Authority (CMDA) to submit detailed responses before the next hearing, effectively pausing all construction activities in the meantime.

Petitioner Highlights Ecological And Legal Violations

According to the PIL, the project was illegally approved within a protected wetland zone, thereby violating the Wetlands (Conservation and Management) Rules, 2017, and the Ramsar Convention’s conservation guidelines.

The petitioner emphasized that the Pallikaranai Marsh plays a crucial role as Chennai’s natural flood buffer, supporting diverse wildlife and rich biodiversity. The PIL further pointed out that continuous encroachments, garbage dumping, and unregulated urbanization have already caused severe ecological degradation, and the new construction could worsen the damage.

Government And Developer Defend Project Clearance

In response, the Tamil Nadu government and the CMDA argued that the Brigade Morgan Heights project lies outside the officially demarcated Ramsar and reserve forest boundaries. They clarified that construction permission was issued only for private patta lands and not on any notified wetland area.

Officials also mentioned that the demarcation of the 1,248-hectare Ramsar site which includes 698 hectares of reserve forest and 550 hectares of adjoining wetlands is currently in progress. The National Centre for Sustainable Coastal Management (NCSCM) is verifying the mapping to ensure clarity on boundary limits.
