Description

Several films in India have faced strict scrutiny and censorship by the Central Board of Film Certification (CBFC) due to content relating to caste, mythology, and political references. This has reignited debates around freedom of expression, creative liberties, and the role of the censorship authority in regulating cinema.

About Central Board Of Film Certification (CBFC)

The Central Board of Film Certification (CBFC) is a statutory authority operating under the Ministry of Information and Broadcasting, Government of India. While popularly referred to as the Censor Board, its primary function is to certify films for public exhibition, rather than to censor content arbitrarily.

The CBFC functions under the framework of:

  • Cinematograph Act, 1952,

  • Cinematograph (Certification) Rules, 1983, and

  • Guidelines issued by the Central Government.

Role And Responsibilities

The CBFC plays a pivotal role in regulating films in India, ensuring that cinema conforms to the law and social norms. Key responsibilities include:

  • Certification of Films: No movie can be released for public viewing in India without receiving a CBFC certificate.

  • Content Examination: Films are reviewed for obscenity, defamation, violence, and themes related to religion, caste, or politics that may affect public order.

  • Guidance and Advisory: Provides recommendations to filmmakers for edits, modifications, or disclaimers where necessary.

Organisational Structure

  • The CBFC is headed by a Chairperson and consists of 12–25 members appointed by the Central Government.

  • The Board operates through nine regional offices across India:

    • Mumbai, Kolkata, Chennai, Bangalore, Thiruvananthapuram, Hyderabad, New Delhi, Cuttack, and Guwahati.

  • Advisory Panels assist in film evaluation. These panels consist of experts nominated by the government for two-year terms.

Film Certification Categories

The CBFC assigns certifications to films based on age suitability and content sensitivity:

  • U (Universal): Suitable for all age groups.

  • U/A (Universal with Parental Guidance): Recommended for children below 12 years with parental guidance.

  • A (Adult): Restricted to viewers aged 18 and above.

  • S (Special): Limited to specific professional or social groups, such as doctors or farmers.

Recent Amendments (2023):

  • Introduced sub-categories under U/A to better align with international standards:

    • UA 7+ – Suitable with parental guidance for children above 7.

    • UA 13+ – Suitable with guidance for viewers above 13.

    • UA 16+ – Suitable with guidance for viewers above 16.

These sub-categories aim to provide more nuanced guidance for parents and audiences, reflecting evolving cinematic content and social sensitivities.

Controversies And Challenges

CBFC’s certification decisions often generate debate, especially when:

  • Films tackle caste dynamics, religious beliefs, or political narratives.

  • Filmmakers argue that edits or bans infringe upon creative freedom.

  • Audience and critics question the subjectivity of content assessment.

While the CBFC is tasked with maintaining social harmony and public order, the recent controversies underscore the delicate balance between regulation and freedom of expression in India’s dynamic film industry.
