On 17 July 2025, the Supreme Court of India issued a historic verdict in the case Ram Charan & Others vs Sukhram & Others, affirming that tribal women cannot be denied their right to ancestral property. The Court ruled that excluding daughters from inheritance violates the fundamental right to equality under the Constitution, marking a major step towards gender justice in tribal communities, where traditional customs often limit women’s rights.

Case Background

The dispute arose from the family of Dhaiya, a tribal woman from Sarguja district, Chhattisgarh. Her legal heirs sought partition of ancestral property passed down from their maternal grandfather. However, the defendant rejected their claim, arguing that tribal customs prevent daughters from inheriting land.

While lower courts dismissed the petition, the High Court later upheld the daughters’ claim, ruling that customary practices excluding women were discriminatory. The matter eventually reached the Supreme Court, which endorsed the High Court’s decision.

Customary Laws And Gender Bias

In many Scheduled Areas, tribal customs regulate marriage, succession, and inheritance, often barring women from owning ancestral land despite their key role in agriculture. Data shows only 16.7% of Scheduled Tribe women own land, compared to 83.3% of men.

Traditionally, these customs aimed to prevent land from leaving tribal communities through marriage with non-tribal men. However, the Court highlighted that such practices rarely serve community welfare and instead reinforce inequality.

Judicial Precedents And Changing Views

Earlier, in Madhu Kishwar vs State of Bihar (1996), the Supreme Court upheld tribal customs that denied inheritance rights to women, fearing disruption of tribal systems. But recent judgments, including Prabha Minz vs Martha Ekka (2022) and Kamala Neti vs Special Land Acquisition Officer (2022), indicate a judicial shift. Courts now examine customs for their antiquity, certainty, fairness, and alignment with public policy before recognising them.

Call For Legal Reform

Currently, the Hindu Succession Act excludes Scheduled Tribes, leaving tribal women without statutory protection. The ruling highlights the urgent need for a Tribal Succession Act, which would codify succession rights for tribal communities while ensuring gender equality and legal clarity. Such legislation could balance cultural traditions with constitutional principles.

Social Impact

Granting inheritance rights to tribal women challenges long-standing patriarchal practices and empowers them socially and economically. Equal property rights enhance women’s participation in decision-making, reduce discrimination, and promote inclusive development in tribal regions. The judgment not only strengthens women’s rights but also urges communities to rethink customs that perpetuate inequality.
