Mass Demonstration Led By Imarat-e-Shariah In Patna

On June 29, a large protest was held in Patna, led by Imarat-e-Shariah, a well-known Muslim socio-religious organisation. The rally witnessed a major turnout and drew support from various political figures, including leaders from the Rashtriya Janata Dal (RJD). Protesters called for the restoration of the original 1995 Waqf Act, expressing deep dissatisfaction with the recent amendments. The protest’s location and timing were seen as strategic, given Bihar’s sizeable Muslim population and the approaching state elections.

Demands Raised By Imarat-e-Shariah

Imarat-e-Shariah has demanded a complete rollback of the amended law. The organisation claims that the Centre overlooked more than 300 objections submitted against the changes. A key concern is the requirement to prove ownership of historically recognised Waqf properties—something the organisation argues is practically unfeasible. It also raised questions about whether similar legal obligations apply to religious properties belonging to other faiths. Leaders have labelled the amendments as a threat to communal harmony and an infringement on constitutional rights.

Core Issues With Waqf Act Amendments

The protestors’ concerns focus on several contentious provisions introduced in the amended Act:

  • Abolition of “Waqf by use”: This change invalidates recognition of religious properties based on long-standing community use without formal registration.

  • Inclusion of non-Muslims in Waqf Boards: Seen as a violation of religious autonomy and internal community matters.

  • Authority granted to District Collectors: Empowering local administrators to declare Waqf lands as government property is viewed as an encroachment on religious freedom.

  • Application of the Limitation Act: This clause restricts legal claims over Waqf land after a specific period, potentially preventing recovery of encroached properties.

These alterations are widely regarded by critics as diminishing the legal protections and independent status of Muslim endowments.

Political And Legal Ramifications

The Waqf amendments have become a politically sensitive issue, especially in Bihar, where opposition parties are mobilising around the matter to connect with Muslim voters. With its longstanding presence in eastern India, Imarat-e-Shariah is leveraging its influence to expand protest efforts. The pending judgment from the Supreme Court adds a layer of uncertainty, though the Union government has hinted at being open to reviewing specific provisions, it has not yet committed to any formal reversal.

Expansion Of Protest Strategy

Following the large-scale demonstration in Patna, Imarat-e-Shariah is now organising district-level protests in West Bengal, Jharkhand, Odisha, and other regions. Plans are underway to coordinate with like-minded organisations in Uttar Pradesh, Maharashtra, and additional states. A national-level protest rally in Delhi is also being considered to draw further attention to the issue and escalate pressure on the central government.
