The Central Board of Direct Taxes (CBDT) has officially granted the National Mission for Clean Ganga (NMCG) tax-exempt status under clause 46A of Section 10 of the Income Tax Act, 1961. This designation classifies NMCG as an eligible authority, relieving it from income tax obligations. The move is expected to enhance its financial autonomy and strengthen its focus on Ganga river conservation.
Understanding Section 10 Of Income Tax Act
Section 10 of the Income Tax Act provides various tax exemptions for statutory bodies created by the government. Clause 46A specifically applies to institutions established under legislative frameworks for public purposes. As NMCG was formed under the Environment (Protection) Act, 1986, it now qualifies for this exemption. The provision is designed to support institutions in executing their public service mandates without the burden of tax liabilities.
NMCG’s Role In River Restoration
The NMCG functions as the main implementing agency of the Namami Gange Mission, launched to address pollution and promote sustainable development along the Ganga River. Since its establishment in 2011, NMCG has supported a range of initiatives including wastewater management, riverbank restoration, and biodiversity enhancement. It funds both infrastructure and ecological projects to revive the health of the river ecosystem.
Past Taxation Issues And Legal Challenges
Previously, NMCG had faced income tax demands totalling over Rupees 243 crore. These arose from its classification as an Association of Persons (AOP) rather than a public authority, triggering a series of tax assessments and legal notices. The organisation subsequently appealed the classification and sought revisions of past tax filings to reflect its actual mandate.
