Description

The Gujarat government is taking significant steps towards implementing the Uniform Civil Code (UCC) in the state. Chief Minister Bhupendra Patel has recently revealed the formation of a five-member committee assigned to draft the UCC. This move follows Uttarakhand's successful implementation of the UCC. The goal of the UCC is to establish a common set of personal laws applicable to all citizens, regardless of religion or gender.

Background Of Uniform Civil Code

The Uniform Civil Code aims to replace personal laws that vary according to different religious communities with a unified set of laws that applies to all citizens. This principle is outlined in Article 44 of the Indian Constitution. The Bharatiya Janata Party (BJP) has consistently supported the UCC, arguing that it ensures equality and fairness in areas such as marriage, divorce, inheritance, and adoption.

Formation Of Committee

The newly formed committee will be led by retired Supreme Court judge Ranjana Desai. Other committee members include senior IAS officer CL Meena, advocate RC Kodekar, former Vice-Chancellor Dakshesh Thakar, and social activist Geeta Shroff. The committee has been tasked with presenting its findings to the state government within 45 days.

Key Goals Of UCC

The UCC's primary aim is to guarantee equal rights for all citizens, addressing key issues such as marriage registration, inheritance rights, and the status of children born from live-in relationships. The Gujarat government believes that a uniform legal framework will eradicate discrimination based on religion and gender, advancing social justice.

Recent UCC Developments In Other States

Uttarakhand recently became the first state to implement the UCC after Independence. Among its provisions, the state now mandates marriage registration and ensures equal property rights for both sons and daughters. Additionally, Uttarakhand has introduced an online portal to streamline marriage and inheritance processes, reflecting a contemporary approach to legal matters.

Political Context And Implications

The push for the UCC aligns with the BJP's broader political agenda, which also includes the revocation of Article 370 and the prohibition of triple talaq. Chief Minister Patel emphasized that the government is determined to fulfill its commitments to citizens by creating a unified legal framework that enhances individual rights.

Public Response And Challenges

While the UCC has received support for promoting equality, it has also faced opposition. Some communities express concerns that the UCC could undermine their religious customs. The Gujarat government plans to address these concerns through wide consultations during the committee’s research phase.
