The Delhi High Court on Monday referred to the operation of "dummy schools" in the national capital as "fraudulent" and ordered strict action against them. The court directed the education department and the CBSE to take measures to curb the activities of these schools. A bench comprising Chief Justice D K Upadhyaya and Justice Tushar Rao Gedela stated that such institutions, which primarily allow students to attend coaching classes and appear for exams based on false information, should not be allowed to function.
The court instructed the education department and CBSE to carry out a survey and, if necessary, conduct surprise inspections to gather pertinent data. Both bodies were directed to share this information with each other and file affidavits detailing any actions taken against the operation of these dummy schools.
The court expressed disappointment over the Delhi government's claim, made by counsel Udit Malik, that no issue of "dummy" schools existed in the city. "You are blissfully unaware... Tell us when you issued a show-cause notice, what actions were taken, and against which schools," the bench remarked. It also highlighted that coaching centres were often involved in these practices, where students would skip regular school attendance and focus only on coaching while still being allowed to take exams by education boards that have attendance requirements.
The court further pointed out that these dummy schools were being exploited to extend Delhi domicile benefits to students from other states, allowing them to gain admission under the Delhi School Quota (DSQ). In response, the CBSE counsel mentioned that over 300 dummy schools across the country had been acted against, with several such institutions found in Delhi.
During the hearing, the Delhi government's counsel mentioned that this issue was portrayed in a web series about students in Kota, Rajasthan. The court retorted, "Your department doesn't seem to have watched it."
The petition, filed in the Public Interest Litigation (PIL), questioned the eligibility criteria used by Delhi University and Guru Gobind Singh Indraprastha University for granting MBBS and BDS seats under the Delhi school quota. The petitioner argued that "dummy" schools were being used to create a virtual residency status for students, who migrated to Delhi after completing class X with the sole aim of availing DSQ benefits, which should otherwise be reserved for legitimate residents of Delhi.
