The Supreme Court of India has issued an order allowing final-year law students to appear insit for the All India Bar Examination (AIBE) exams. The order challenges the Bar Council of India's decision to exclude final-year law students from appearing in the exams.
The AIBE XIX examinations are set for November 24, 2024. The Supreme Court bench, chaired by CJI DY Chandrachud, Justice JB Pardiwala, and Manoj Misra, was hearing a case challenging the BAR council's recent notification about the eligibility conditions for the AIBE XIX exam. The SC bench order specifies that the BCI must allow the registration of all pupils who fall within paragraph 38 of the Bonnie Foi decision. The direction has been provided to operate in rem for AIBE, which is slated for November 2024.
The petition claims that the BCI notification hinders them from taking the AIBE XIX exam. The decision contradicts the constitutional bench decision in Bar Council of India v. Bonnie Foi Law College, which states that final-year law students should be able to sit for the AIBE.
According to Paragraph 38 of the Bonnie Foi Law College decision, students who have passed all of the exams required to pursue the final semester of their law course may be permitted to take the AIBE exam if they present proof. The results of the exams, however, will only be valid if the candidate has passed all of the components of their course and will only be valid for a limited time.

The online registration and application process for AIBE XIX exams has begun. According to the program, the last deadline for students to apply for the tests is October 25, 2024. Candidates who meet the eligibility requirements must submit their applications by the deadline. AIBE XIX will be held on November 24, 2024.
