The 'Aparajita Woman and Child Bill (West Bengal Criminal Laws and Amendment) 2024' was unanimously enacted by the West Bengal Assembly, marking a significant step forward in the state's legal framework against sexual offenses. This bill establishes the death sentence for anyone convicted of rape if their actions kill the victim or put her in a vegetative state. With this move, West Bengal becomes the first state to change central rules governing rape, gang-rape, and sexual offenses against children.
Key Provisions Of The Bill
The 'Aparajita' law honors a 31-year-old trainee doctor who was raped and murdered at RG Kar Medical Centre and Hospital last month. The bill's main provisions are-
The death penalty- is imposed for rape if the victim dies or suffers serious brain damage.
Life Sentence- Those convicted of rape face life in prison without the possibility of parole.
Aparajita Task Force- Ensure punishment within 21 days of the preliminary report.
Enhanced Safety Measures- Installation of CCTV cameras and additional protection on routes utilized by female healthcare workers, at a budget of Rs 120 crore.
The 'Ratri Saathi'- provision extends female workers' job hours to ensure their safety during night shifts.
Political Reaction And Implementation
Chief Minister Mamata Banerjee praised the law as 'historic' and encouraged Leader of the Opposition Suvendu Adhikari to seek for its prompt approval by Governor CV Ananda Bose and President Droupadi Murmu. Banerjee condemned the high crime rates against women in states such as Uttar Pradesh and Gujarat, highlighting that West Bengal's court system provides justice to victims.
The BJP has praised the law, although it should be remembered that the Bhartiya Nyay Sanhita (BNS) includes harsh provisions for dealing with crimes against women and children. Adhikari recommended revisions and emphasized the importance of early implementation of the new law, stating that the state government must ensure its passage without delay.
