Description

There is continuing discussion regarding a potential government bill to amend the Waqf Act of 1995. This measure seeks to strengthen accountability and transparency in Waqf boards while also encouraging the inclusion of women in its management.

Understanding Waqf Boards

Waqf Boards in India, established under the Waqf Act of 1995, oversee Waqf properties. These properties serve religious, social, and educational institutions. There are 30 Waqf Boards in India, which supervise properties worth crores of rupees and generate approximately Rs 200 crore in annual revenue.

About Waqf

A Waqf is a charitable donation in Islamic law that typically involves property given for religious or philanthropic reasons. The administration of Waqf properties is often managed by a mutawalli, who might be an individual or a management team.

The Government's Position

Former Minority Affairs Minister Mukhtar Abbas Naqvi and other government officials advocate for reforms that will make Waqf management more accountable and inclusive, as well as remove political impediments. However, several Muslim organizations, particularly the All India Muslim Personal Law Board (AIMPLB), are highly opposed to the planned reforms. They feel that these reforms will undermine Waqf boards' autonomy and legal status.

Political Dynamics Around Waqf Boards

Waqf Boards wield considerable power within the Muslim community. Various political groups, particularly those that promote secularism, resist measures that they regard as intruding on Muslim rights, as they have in the past with the Triple Talaq Bill.

Historical Timeline Of Waqf Legislation

Here's a quick overview of Waqf legislation in India-

  • 1913- The first acts relating to Waqf properties were introduced.

  • 1923- The UP Muslim Waqf Act was enacted in 1923, during British administration.

  • 1936- The State of Uttar Pradesh enacts its own Waqf Act.

  • 1942- The UP Sunni Central Waqf Board was established.

  • 1960- A comprehensive UP Muslim Waqf Act superseded previous laws.

  • 1995- The Central Waqf Act was passed to ensure uniform administration, with additional revisions in 2013.

The government's initiatives to overhaul Waqf boards have sparked both support and criticism, with concerns about accountability, representation, and religious sensitivities among the Muslim population.
