Description
The MahaYuti government, led by the Bharatiya Janata Party (BJP), approved the Maharashtra Special Public Security (MSPS) Act on July 11, 2024. This rule was intended to prevent the spread of Naxalism in cities. The proposed "urban naxal" law has sparked much discussion.
The Purpose Of The Bill
The government claims that Naxal-related activities are becoming more widespread in cities. Deputy Chief Minister Devendra Fadnavis discusses the role of frontal organizations in assisting Maoist militants with supplies. The law is intended to provide the government with the necessary instruments to effectively control these activities.
Comparison Of Existing Laws
The MSPS Act is similar to the Unlawful Activities (Prevention) Act (UAPA), but it provides alternative methods for keeping a check on things. An advisory board will confirm the names of illegal groups rather than using the UAPA's tribunal approach. In this situation, the Maharashtra Control of Organized Crime Act (MCOCA) is also relevant.
Key Provisions Of The MSPS Act
The Act grants the government the authority to declare any association illegal and identifies four major crimes-
Being a member of an illegal group.
Raising funds for or hiding members of a criminal organization.
Organizing or promoting unlawful groups or events.
Taking part in or intending to commit criminal acts. Fines and jail sentences ranging from two to seven years are conceivable.
Legislative Status
The Bill has been introduced in the Lower House, but the Assembly's term is about to end. Its future is uncertain, especially with elections coming up soon. The bill is no longer applicable because the summer session has ended.
Opposition's Response
Opposition leaders, including former Chief Minister Prithviraj Chavan, have criticized the Bill as harsh and useless, claiming that existing laws are sufficient to regulate Naxal activity. Chavan claims that the administration is attempting to muzzle criticism, implying that if the government changes, the Bill may be overturned.
