The Finance Ministry has announced regulations governing the appointment and conditions of service for the president and members of GST Appellate Tribunals. These rules, known as the Goods and Services Tax Appellate Tribunal (Appointment and Conditions of Service of President and Members) Rules, 2023, establish a framework for the tribunal's key personnel's selection, tenure, and perks.
Age Limit
The GST Council, chaired by the Union Finance Minister and comprised of state counterparts, introduced age limitations for the president and members of the GST Appellate Tribunal (GSTAT) during its 52nd meeting on October 7. The president's maximum age has been set at 70 years, while members may not be older than 67.
GSTAT Bench Expansion
In September, the Finance Ministry announced the establishment of 31 GSTAT benches to improve the efficiency of the GST dispute resolution procedure. These benches may be found in 28 states and 8 union territories. The establishment of state-level benches is expected to greatly help businesses by speeding the adjudication of GST-related disputes.
More Rapid Dispute Resolution
Currently, taxpayers who are dissatisfied with tax authorities' verdicts must seek redress in the various High Courts. This approach frequently results in delays since High Courts are overburdened with litigation and lack specialized benches to handle GST-related problems. The introduction of GSTAT benches at the state level is an important step toward streamlining the resolution process and providing taxpayers with a speedier turnaround.
GSTAT Bench Distribution
According to the notification, GSTAT benches are assigned as follows:
Gujarat: Two benches
Union Territories (Dadra and Nagar Haveli and Daman and Diu): Two benches
Goa and Maharashtra: Three benches combined
Karnataka: Two benches
Rajasthan: Two benches
Uttar Pradesh: Three benches
West Bengal, Sikkim, Andaman and Nicobar Islands, Tamil Nadu, and Puducherry: Two benches each
Kerala and Lakshadweep: One bench
Northeastern States (Arunachal Pradesh, Assam, Manipur, Meghalaya, Mizoram, Nagaland, and Tripura): One bench each
