In response to a request from the Ministry of Information and Broadcasting (MIB), the Telecom Regulatory Authority of India (TRAI) issued recommendations on FM radio broadcasting issues. The goal of these recommendations is to address key FM radio broadcasting issues, such as calculating annual license fees, extending license periods, allowing private FM radio news broadcasting, ensuring the availability of FM radio receivers in mobile handsets, and establishing compliance oversight measures.
Separating the Annual License Fee from the Entry Fee
The TRAI advises that the annual license fee for FM radio channels be separated from the Non-Refundable One-Time Entry fee (NOTEF). Instead, the licensing price should be computed as 4% of the FM radio channel's Gross Revenue (GR) during the respective fiscal year, with GST deducted from GR.
FM License Period Extension
TRAI proposes increasing the existing FM license period of 15 years by additional three years.
Private FM Radio Broadcasting of News
TRAI advises allowing private FM radio networks to carry independent news bulletins for a maximum of 10 minutes per clock hour. It also proposes that private FM radio broadcasters follow the same program code of conduct for news programming as All India Radio.
FM Radio Receivers in Mobile Phones
TRAI proposes that FM radio services or features stay enabled and activated on all mobile handsets equipped with the requisite hardware. Built-in FM radio receivers in mobile phones must not be disabled or deactivated in any way.
Compliance Monitoring
TRAI recommends the formation of a Standing Committee, chaired by a senior officer of Joint Secretary or higher level, to oversee and monitor mobile phone manufacturers' (or importers') compliance with the inclusion of FM radio capabilities in mobile handsets. Key stakeholders such as MIB, AROI, MAIT, and ICEA should be represented on the committee.
Online Grievance Resolution Portal
TRAI advises the establishment of an online grievance redressal portal for the submission of information or complaints in cases of non-compliance regarding the activation of FM radio capabilities in mobile handsets equipped with the necessary hardware.
