In its decision, the High Court also said that wearing the headscarf is not a fundamental religious practise of Islam. A Karnataka High Court bench comprised of Chief Justice Ritu Raj Awasthi, Justice Krishna S Dixit, and Justice JM Khazi stated that no cause has been made out for invalidating the Government's February 5 Order. On February 5, 2022, the Karnataka pre-university education board said that all pupils must stick to the Uniform and prohibited both hijab and saffron scarves until an expert committee resolved on the matter.
Background on the Karnataka Hijab Controversy
The hijab controversy emerged in Karnataka in January 2022, when the Government PU Campus in Udupi allegedly prevented six females wearing hijab from attending the college. Following the imposition, the females sat outside the campus in protest at being denied admittance. Following this, the lads of numerous institutions in Udupi began wearing saffron scarves to class. The outrage moved to other districts of Karnataka, resulting in protests and agitations in various locations across the state. As a consequence of the movement, the Karnataka government mandated that all students wear the uniform and prohibited both hijab and saffron scarves until an expert committee resolved on the matter.
What did the Karnataka government decree say about the hijab controversy?
According to the decision issued by the pre-university education board, if a uniform is not established by the management committee, students shall wear clothes that are in keeping with the spirit of equality and unity and do not disrupt the social order. Petitions have been filed to overturn the hijab ban at educational institutions. Some females seeking permission to wear the hijab at educational institutions filed a batch of petitions in the High Court of Karnataka against the Government's rule prohibiting the hijab in educational institutions.
On March 15, a Karnataka High Court bench comprised of Justice Krishna S Dixit, Chief Justice Ritu Raj Awasthi, and Justice JM Khazi heard petitions challenging the Government's dress code policy.
Karnataka High Court Issues Interim Order in Hijab Case
On February 10, the Karnataka High Court issued an interim ruling declaring that the aforementioned pupils must not wear religious apparel to school until the court gives a final order. The proceedings in Karnataka connected to the Hijab debate completed on February 25, 2022, and the High Court reserved its decision.
