Description

The Madras High Court has accused the management of an engineering college of withholding government financial aid to a needy student, causing him trouble.

The petitioner/student was subjected to ignominy as a result of Rajalakshmi Engineering College holding the money due to the petitioner for reimbursement to an Indian Bank branch, in that he had been visited with notices both legally and from the Lok Adalat, and had been harassed to the point where it appeared as if he had flown away with the money.

The petitioner had been subjected to a mental and financial torture by the bank, which had not prolonged the moratorium period due to no fault of his own.

The petitioner was not entitled to an extension of the moratorium, but he was certainly entitled to the amount from the college, which, if reimbursed sooner, would not have resulted in the situation he had found himself in, as well as the monetary loss he had incurred in the form of interest and penal interest.

"The petitioner's said sufferings clearly demand compensation at the hands of the college for interest on the sum retained by it that was meant to be given to the petitioner for refund of the bank loan," Justice M Dhandapani remarked.

The Bench was recently dealing with a writ petition filed by C Ashok Kumar, who asked the Registrar of Anna University and the Commissioner of Technical Education to consider his representation and recover from the college the entire education fee paid to it under various heads during the course, as well as interest and other incidental charges incurred by him on the educational loan account, and refund the same to him to enable him to re-pay the out-of-pocket expenses.

The judge ordered Anna University and the Technical Education Commissioner to take necessary action against the college for improper withholding of funds provided by the government for financial aid.

He ordered the college to restore the sum of Rs 60,000 (Rs 20,000 for each year) with interest at the rate of 7.5 percent per annum from the moment the college received the money from the government until the date the petitioner was paid.
