Description

A Public Interest Litigation (PIL) has been filed in the Supreme Court seeking directions on the question of admission and continuation of studies in the nation for Indian medical students who were recently evacuated from war-torn Ukraine. The petition also asked the Centre to give a medical subject equivalency orientation programme in order for them to be admitted to the Indian curriculum. According to the writ suit filed by Counsel Rana Sandeep Bussa and others, their writ petition seeks to invoke the most important basic right protected by Article 21 - the protection of life and personal liberty. Since the outbreak of war between Russia and Ukraine, and the return of students from Ukraine, multiple petitions have been filed in high courts and the Supreme Court, requesting that the Centre direct to allow Indian medical students who have returned from Ukraine to continue their studies in domestic colleges. Pravasi Legal Cell has also petitioned the Delhi High Court for a directive to the Centre in this respect. According to the plea filed in the Supreme Court, the Union government has done an excellent job of relocating Indian students, but they are being denied their fundamental right to an education. It stated that the government must intervene to ensure the essential integration of foreign medical students into the Indian medical curriculum. "A number of Indian students studying in Ukraine have been uprooted from their medical colleges and are forced to leave behind their medical studies in between, and this war has created significant financial, mental, physical, and intellectual stress for the Indian medical students," the petition stated.

Because of the on-going conflict between Ukraine and Russia, the National Medical Commission has authorised international medical graduates to finish their internships in India, according to the petition, "therefore in this context, the government must recognise the hardship of these medical students."
