Supreme Court directs IIT-Madras to treat OCI students at par with Indian students in fees

Description

The Supreme Court on Tuesday ordered IIT-Madras to charge an Overseas Citizen of India (OCI) student the same fees as Indian students. The court, which included Justices Abdul Nazeer and Krishna Murari, referred to its interim judgement dated October 27, 2021, which enabled an OCI NEET PG aspirant to participate in general category counselling alongside Indian citizens and granted him relief.

"After hearing from counsel for both parties, we believe that the respondent-IIT Madras should treat the applicant/petitioner on an equal footing with Indian nationals when it comes to the amount charged under our order dated October 27, 2021, subject to the outcome of this petition. As a result, the application is dismissed "The bench remarked.

The petitioner's senior counsel, Anitha Shenoy, said that the institute is requesting them to pay according to the tuition structure established for foreign nationals. She claimed that OCI students had been paying the same rate as their Indian counterparts for the previous 12 years, but that this had been switched without warning in 2021.

The petitioner's lawyer had previously claimed that IIT Madras was requiring the student to pay the same costs as foreign nationals, citing the apex court's judgement permitting OCI candidates to attend NEET counselling in the general category on the same terms as local residents.

It was argued in the petition that classifying OCIs the same as non-resident Indians and foreign nationals was unreasonable. The OCI card, which is extremely popular among abroad Indians, allows for long-term visa-free travel and residence in India, as well as a slew of other benefits not available to foreign nationals.
