The Supreme Court has postponed the hearing of a petition challenging the center's and the Medical Counselling Committee's (MCC) decision to give 27% quota for OBCs and 10% for EWSs for admission to postgraduate medical seats through NEET. The case will be heard by the Supreme Court on November 23.
NEET PG counselling for 50% AIQ seats was supposed to start on October 25, 2021. The NEET PG counselling dates for 2021 have been postponed by MCC. In addition, the Centre had already told the Supreme Court that NEET PG 2021 counselling would not begin until the court resolved the issue to the 27 percent reservation for OBCs and 10% for EWSs in PG all India quota seats (MBBS/BDS and MD/MS/MDS) from the current academic session.
The assurance was recorded by a bench of Justices DY Chandrachud and BV Nagarathna, who also noted that if counselling takes place before the Court makes a ruling, "kids will be in a major situation." "We will take your word for it then, so long as the students are not counselled. We will take your word that counselling is not starting till we decide one way or the other. Students will be in a serious problem otherwise..." Justice Chandrachud said.
The Supreme Court had asked the Centre on October 21 if it wanted to rethink the Rs 8 lakh annual income limit for calculating the EWS category for reservation in NEET medical admissions. The Centre justified its decision to set a maximum of Rs 8 lakh yearly income for defining the EWS category for reservation in NEET admissions for medical courses before the Supreme Court on October 26. The Ministry of Social Justice and Empowerment argued in an affidavit filed with the Supreme Court that the principle of determining the amount is rational and consistent with Articles 14, 15, and 16 of the Constitution.
